Quantum Alliance

Terms and Conditions

Effective date: [INSERT DATE] | Last updated: [INSERT DATE]

1. Acceptance of These Terms

These Website Terms and Conditions (the “Terms”) govern access to and use of [WEBSITE URL], any associated client or agent portal, online forms, quote-request tools, messaging features, and other websites or digital services that link to these Terms (collectively, the “Site”). The Site is operated by [FULL LEGAL ENTITY NAME], doing business as Quantum Alliance (“Quantum Alliance,” “we,” “us,” or “our”).

By accessing or using the Site, creating an account, submitting information, requesting a quote, electronically signing a document, or using any Site feature, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Site.

You represent that you are at least 18 years old and have legal capacity to agree to these Terms. If you act for a business or another person, you represent that you have authority to bind that party.

2. About Quantum Alliance and Insurance Services

Quantum Alliance is an insurance agency and related-services provider, not an insurance company, unless a specific page expressly states otherwise. Insurance products are issued and underwritten by third-party insurers. [INSERT TEXAS AGENCY LICENSE INFORMATION AND ANY REQUIRED STATE-SPECIFIC DISCLOSURES].

Product availability, eligibility, underwriting, pricing, discounts, coverage terms, and claims decisions are controlled by the applicable insurer and policy documents. Not all products or insurers are available in every jurisdiction. The Site is intended for persons located in jurisdictions where Quantum Alliance and the relevant providers are authorized to conduct business.

3. No Binder, Coverage, or Professional Advice

Information on the Site is general and is not legal, tax, accounting, financial, risk-management, or other professional advice. Nothing on the Site changes, expands, or replaces the terms of an insurance policy, endorsement, binder, declaration, or written agreement.

Submitting an application, quote request, payment, document, email, text message, or other communication does not bind, renew, reinstate, amend, or cancel insurance coverage. Coverage is effective only when confirmed in writing by an authorized representative or insurer and when all applicable conditions are satisfied. Do not rely on the Site for urgent coverage changes, claims reporting deadlines, cancellation requests, or time-sensitive instructions. Contact Quantum Alliance or the insurer directly using verified contact information.

Quotes and indications are estimates based on information available at the time and may change after underwriting review, verification, inspection, reports, or carrier approval. If a policy conflicts with Site content, the policy controls.

4. Permitted Use and Prohibited Conduct

Subject to these Terms, Quantum Alliance grants you a limited, personal, revocable, non-exclusive, non-transferable right to use the Site for lawful purposes related to evaluating or obtaining our services.

  • You may not violate any law, regulation, court order, or third-party right.
  • You may not submit false, misleading, fraudulent, incomplete, or unauthorized information, impersonate another person, or misrepresent your authority.
  • You may not interfere with Site operation or security, introduce malicious code, bypass access controls, probe vulnerabilities, overload systems, or use automated tools to scrape, harvest, index, or systematically retrieve content without written permission.
  • You may not copy, modify, publish, sell, sublicense, reverse engineer, frame, mirror, create derivative works from, or commercially exploit Site content except as expressly allowed by law or written permission.
  • You may not use the Site to send spam, unlawful solicitations, defamatory or harassing material, or content that infringes intellectual-property or privacy rights.
  • You may not use outputs, content, data, or interfaces from the Site to train or improve an artificial-intelligence or machine-learning system without our prior written consent.

5. Accounts, Credentials, and Electronic Instructions

Certain features may require an account. You agree to provide accurate and current information, maintain the confidentiality of credentials, use reasonable security measures, and promptly notify us at [SECURITY EMAIL/PHONE] of suspected unauthorized access. You are responsible for activity conducted through your credentials to the extent permitted by law.

We may rely on instructions received through an authenticated account, but may suspend access, decline a transaction, or request additional verification if we reasonably suspect fraud, unauthorized use, a security risk, or violation of these Terms. We may require multifactor authentication or other security controls.

6. Electronic Communications and Signatures

When you transact electronically, you consent to receive records, disclosures, notices, and agreements electronically, subject to applicable law and any separate electronic-consent disclosure presented to you. You agree that electronic signatures and records may have the same legal effect as paper documents and handwritten signatures under applicable law, including the federal Electronic Signatures in Global and National Commerce Act and the Texas Uniform Electronic Transactions Act, when their requirements are met.

You are responsible for maintaining a valid email address, compatible device, internet access, and software capable of displaying and retaining electronic records. Any separate electronic-consent disclosure controls if it conflicts with this section. [INSERT PROCESS FOR WITHDRAWING CONSENT AND REQUESTING PAPER COPIES].

7. Telephone Calls, Text Messages, and Mobile Alerts

7.1 Telephone Calls

If you provide a telephone number, you represent that you are the subscriber or customary user of that number and authorize Quantum Alliance and its service providers to contact you regarding your request, account, policies, transactions, service, security, or claims, as permitted by law. Calls may be made using an automatic telephone dialing system, prerecorded or artificial voice, or similar technology only when permitted by applicable law and supported by any required consent. Marketing consent, when requested, will be presented separately and is not a condition of purchasing insurance or services.

7.2 Text Messages and Mobile Alerts

If you expressly opt in to a Quantum Alliance text-message program, you authorize Quantum Alliance and its messaging service providers to send recurring automated text messages to the mobile number you provided for the purposes described at enrollment. Consent to marketing text messages is not a condition of purchasing any property, goods, insurance product, or service. Message frequency varies. Message and data rates may apply.

The enrollment disclosure for each program will identify Quantum Alliance as the sender, describe the program and message purpose, state the expected or variable message frequency, include “message and data rates may apply,” provide instructions to text STOP to cancel and HELP for help, and link to these Terms and the Privacy Policy. Where required, a confirmation message will be sent after enrollment. Supported carriers and delivery availability may vary. Carriers are not liable for delayed or undelivered messages.

You may revoke consent and opt out of a text-message program at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to a message from that program, or by using another reasonable opt-out method stated in the enrollment disclosure. After an opt-out request, we may send one final message confirming your request. Reply HELP for help or contact us using the information in Section 24. If you later want to resume messages, follow the applicable program instructions, which may include replying START or UNSTOP.

An opt-out from marketing texts does not prevent Quantum Alliance from sending non-marketing communications that are permitted by law, such as messages you specifically request or messages needed to service an existing account, policy, transaction, claim, security event, or legal obligation. When legally required, we will obtain separate consent for marketing and non-marketing programs. Consent and opt-out preferences are program-specific unless the applicable disclosure states otherwise.

You represent that you are the subscriber or customary user of the mobile number provided and that you are authorized to consent to messages at that number. Consent is not transferable. Notify us promptly if you change, surrender, or stop using the number. We may use reasonable methods to identify reassigned or invalid numbers and suppress further messages. Do not provide a number belonging to another person without authorization.

We may maintain records of consent, enrollment disclosures, message content, timestamps, source pages, IP addresses, opt-out requests, and related program activity to document compliance, operate the program, and resolve disputes. We do not authorize the use of purchased, rented, scraped, or third-party lead lists for text-message enrollment unless the consent record specifically and lawfully authorizes messages from Quantum Alliance.

7.3 Email Communications

If you provide an email address, you authorize Quantum Alliance and its service providers to send operational and transactional emails related to your requests, quotes, account, policies, documents, payments, claims, security, and services. Where required by law, marketing emails will be sent only with appropriate consent or another lawful basis.

Marketing emails will identify the sender, use accurate header and subject-line information, include a valid physical postal address, and provide a clear unsubscribe method. You may unsubscribe from marketing emails by using the link in the message or by contacting us. We will process opt-out requests within the period required by applicable law. Even after you opt out of marketing email, we may continue sending non-marketing messages that are necessary to complete a transaction, service an account or policy, respond to your request, provide security or legal notices, or satisfy legal obligations.

You are responsible for providing an accurate email address and updating it when it changes. Email delivery is not guaranteed and may be delayed, filtered, blocked, or redirected. Do not send highly sensitive information by ordinary email unless Quantum Alliance specifically directs you to an approved secure method.

8. Payments

If the Site permits payments, you authorize the disclosed one-time or recurring transaction using the payment method you provide. You represent that you are authorized to use the payment method and that the information is accurate. Additional payment, autopay, premium-finance, refund, returned-payment, or convenience-fee terms may apply and will be disclosed separately.

A submitted payment does not by itself bind, renew, reinstate, or prevent cancellation of coverage. The insurer’s records, applicable policy terms, and written confirmations control. We may remove an invalid or closed payment method and may use service providers to process payments securely.

9. Privacy, Security, Analytics, and Location Information

Our collection and use of personal information is described in our Privacy Policy, available at [PRIVACY POLICY URL], which should be read with these Terms. The Privacy Policy is not incorporated in a way that limits rights or obligations that cannot lawfully be limited.

We and our service providers may use cookies, pixels, analytics, fraud-prevention tools, session-replay technology, and similar technologies as described in the Privacy Policy and any applicable cookie notice. We may infer an approximate location from an IP address to localize content, prevent fraud, or determine product availability. We do not guarantee that security controls will prevent every unauthorized intrusion or disclosure.

10. Intellectual Property

The Site and its content, including text, graphics, logos, icons, photographs, audio, video, software, databases, design, arrangement, and compilation, are owned by or licensed to Quantum Alliance and are protected by copyright, trademark, trade-secret, and other laws. Quantum Alliance names, logos, slogans, and service marks may not be used without prior written permission. Third-party names and marks belong to their respective owners.

You may view and print reasonable portions of publicly available Site content for personal, non-commercial use, provided you do not alter the content and retain proprietary notices. No other license is granted, and all rights not expressly granted are reserved.

11. User Submissions and Feedback

Do not submit confidential business information, trade secrets, or ideas you expect us to treat as confidential unless we have a written confidentiality agreement. If you voluntarily provide non-confidential suggestions or feedback, you grant Quantum Alliance a perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, distribute, and otherwise exploit that feedback without compensation or attribution. This license does not apply to personal information, which is handled under the Privacy Policy, or to documents submitted solely for servicing an insurance transaction.

You represent that you have the rights and permissions needed for content you submit and that it does not violate law or third-party rights.

12. Copyright Complaints

If you believe Site material infringes your copyright, send a written notice to our designated contact at [DMCA AGENT NAME, ADDRESS, EMAIL, AND PHONE]. The notice should include: (1) a physical or electronic signature of an authorized person; (2) identification of the copyrighted work; (3) identification and location of the allegedly infringing material; (4) your contact information; (5) a good-faith statement that the disputed use is unauthorized; and (6) a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. We may remove material and address repeat infringement as appropriate under the Digital Millennium Copyright Act.

13. Third-Party Services and Insurer Websites

The Site may link to or integrate with insurers, payment processors, premium-finance companies, identity-verification providers, e-signature platforms, mapping services, social networks, or other third parties. Those services are controlled by their own terms and privacy notices. Quantum Alliance does not control and is not responsible for third-party availability, security, content, products, decisions, or practices. A link or integration does not imply endorsement unless expressly stated.

14. Artificial Intelligence and Automated Tools

The Site may use automated tools, including chatbots or artificial-intelligence-assisted features, to route requests, summarize information, or support service. Automated output may be incomplete or inaccurate and is not a coverage determination, underwriting decision, or professional advice. You must verify material information with an authorized representative and the governing policy or insurer documents. Do not submit sensitive information to a general chat feature unless the interface specifically requests it and provides an appropriate privacy notice.

15. Availability, Changes, and Termination

We may modify, suspend, restrict, or discontinue any part of the Site at any time, subject to applicable law. We do not guarantee that content will remain available, that you will qualify for a product, or that every error will be corrected. We may terminate or restrict access if we reasonably believe you violated these Terms, created risk, or used the Site unlawfully.

16. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL CONTENT, TOOLS, AND SERVICES MADE AVAILABLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” QUANTUM ALLIANCE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, FREE OF HARMFUL COMPONENTS, OR CURRENT AS OF ANY PARTICULAR DATE.

SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS DISCLAIMS A WARRANTY OR DUTY THAT CANNOT LAWFULLY BE DISCLAIMED.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, QUANTUM ALLIANCE AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, PRODUCERS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SITE, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE QUANTUM ALLIANCE PARTIES FOR CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNT YOU PAID DIRECTLY TO QUANTUM ALLIANCE FOR THE SPECIFIC SITE SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, AND IT DOES NOT ALTER RIGHTS OR OBLIGATIONS UNDER AN INSURANCE POLICY.

18. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Quantum Alliance parties from third-party claims, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, your material breach of these Terms, content you submit, or your infringement of another person’s rights. This section does not require indemnification for a Quantum Alliance party’s own negligence or misconduct to the extent prohibited by Texas law.

19. Governing Law and Venue

These Terms and disputes arising from the Site are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where federal law controls. Unless applicable law requires otherwise or the parties agree in writing to another forum, exclusive jurisdiction and venue will lie in the state courts located in Rockwall County, Texas, or the federal court with jurisdiction over Rockwall County, Texas. You and Quantum Alliance consent to personal jurisdiction in those courts.

Before filing a Site-related lawsuit, the complaining party will provide written notice describing the dispute and requested relief and allow 30 days for informal resolution. This paragraph does not prevent a party from seeking temporary injunctive relief, meeting a legal deadline, reporting a matter to a regulator, or exercising a non-waivable right.

20. State-Specific and Regulatory Rights

Insurance is regulated by state law. Nothing in these Terms limits your right to contact an insurance department, consumer-protection agency, law-enforcement authority, or other regulator, or to exercise a right that cannot be waived. State-specific notices, policy terms, carrier rules, and separate agreements control over these Terms to the extent of a conflict.

21. Changes to These Terms

We may revise these Terms by posting an updated version and changing the “Last updated” date. Changes apply prospectively when posted unless a later effective date is stated or additional notice is required by law. Your continued use after the effective date constitutes acceptance. Material changes to an existing account relationship may be communicated through the Site, email, or another reasonable method.

22. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the Site. Insurance applicants and account holders must be adults with legal capacity. A parent or guardian who believes a child submitted personal information should contact us at [PRIVACY EMAIL].

23. Miscellaneous

These Terms, together with any applicable Privacy Policy, electronic-consent disclosure, program-specific terms, and transaction documents, constitute the agreement concerning use of the Site. Policy documents and signed service agreements separately govern insurance coverage and contracted services. If a provision is invalid or unenforceable, it will be enforced to the maximum lawful extent and the rest will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, reorganization, sale, or transfer of the Site or business. Headings are for convenience only. Sections that by their nature should survive termination will survive, including intellectual-property, disclaimers, liability limits, indemnification, and dispute provisions.
